Long Terms and Conditions

These terms and conditions (the Terms”) apply to the Beefeater Portrait Prize 2021 (the Promotion”) which is run in collaboration with Wasted Talent Limited trading as The Face (“The Face”). The Face is the original, definitive style magazine, championing fresh talent in music, fashion, TV, film and beyond on the​face​.com and as a quarterly print publication.

These Terms will prevail in the event of any conflict or inconsistency with any other communications or promotional materials. Entry instructions are deemed to form part of the Terms and by participating all entrants will be deemed to have accepted and be bound by these Terms. Please retain a copy of these Terms for your information.

2. Eligibility: Promotion open to residents of the United Kingdom (England,
Scotland, Wales and Northern Ireland) and the aged 18 years and over,
except employees and families of the Promoter and its affiliate
companies, agencies and anyone professionally connected with the

3. Promotional Period: The Promotional Period shall begin at 00:01 GMT on
10th August 2021 and end at 23:59 GMT on 7th September 2021.

4. Entry Instructions

4.1 Entrants must:

a. Make sure their Instagram account is public;

b. Take a photo with a subject of their choice which encapsulates their Spirit of London” and which includes either individuals or groups of people;

c. Post the photo to Instagram with a complimenting caption to bring further context to the entry, using the hashtags #beefeaterportraitprize #thespiritoflondon and tag @beefeatergin;

d. Make sure all necessary rights and permissions for featured individuals are secured for full commercial and editorial (print and digital) publication rights as set out in these Terms;

e. Make sure the file is of photographic nature (eg. no scans of paintings or drawings); and

f. Make sure submissions do not include any nudity, drugs, alcohol, swearing, sexual activity (with the exception of kissing), individuals and groups under the age of 18, smoking.

4.2 No purchase necessary for all entries. Entry is free.

4.3 Entrants can enter as many times as they wish across the Promotional Period but only one image per entrant can be shortlisted to win.

5. Prizes

5.1 There will be three prizes available (collectively, the Prizes”):

a. The first place winner will receive a £2,500 cash prize to fund a photography series of their own choosing as well as two mentoring meetings of up to one hour with one of the judges, a bottle of Beefeater London Dry Gin and a copy of The Face Autumn 2021 issue.

b. The second place winner will receive two mentoring meetings of up to one hour with one of the judges as well as film (up to £200 worth) to support future work, a bottle of Beefeater London Dry Gin and a copy of The Face Autumn 2021 issue.

c. The third place winner will receive film (up to £200 worth) to support future work, a bottle of Beefeater London Dry Gin and a copy of The Face Autumn 2021 issue.

6. Winner Selection

6.1 A panel of judges selected by The Face and made up of:

  • Emily Todd – Content Editor at Beefeater, Pernod Ricard UK;
  • Jessica Noah Morgan – Deputy Editor at The Face;
  • Robin Sinha – Curator at Leica Akademie;
  • Mimi Gray & Sarah Williams – Founders of Darklight Art;
  • Richard Chan – Founder of Chan Photographic; and
  • Frank Okolo – Founder of Parallax Coop.

The judges will review all entries and come to a decision as to which photo entry best encapsulates the Spirit of London”. The winners will be chosen and contacted by 14th September 2021 by The Face via Instagram direct message with details of how to claim the Prizes.

6.2 All winners will be asked to verify that they are over 18 before receiving their prize as well as to provide their address for delivery. The winner of the main cash prize will be asked to provide bank details for an account held within the UK. The first place winner will receive payment of their prize to their UK bank account within 14 days of providing their bank details to The Face.

6.3 Where a winner fails to respond to this message within 10 working days, a new winner will be chosen via the same process.

7. Personal Data

7.1 Personal data which is provided by entrants on entering the Promotion will be processed by The Face, who is the Data Controller, for the purpose of managing entry into the Promotion. By providing personal information, entrants consent to the processing and storage of personal information by The Face for this purpose. The Face’s privacy policy is available here.

7.2 In the event that a reasonable request is made, including by the Advertising Standards Authority or any other competent body, the Promoter will provide the surname and county of residence of the winner of the main cash prize.

8. Intellectual Property

8.1 By entering the Promotion, each entrant grants to the Promoter and The Face a perpetual, transferable, non-exclusive, royalty-free licence to use their photo entry for publicity related to the Promotion (Beefeater Portrait Prize 2021), in whatever media Promoter or The Face choose, including but not limited to the​face​.com, The Face printed magazine, beefeater​gin​.com and related social media channels.

8.2 An entrant may only submit an entry that depicts themselves and if the entry depicts a third party, the entrant confirms that they have that third party’s consent and have secured all third-party permissions and releases necessary to grant the permissions to the Promoter and The Face set out in these Terms. The entry must be the entrant’s own original creation.

8.3 Entrants may not enter or upload any content which contains any third party’s trademarks or intellectual property rights or anything that infringes upon any third party’s rights or which is offensive, pornographic, illegal, unlawful or which, in the Promoter’s sole opinion, promoted irresponsible alcohol consumption or anything else which reflects negatively on the Promoter or its products. The Promoter may disqualify any entry without notice or explanation if it contains anything that the Promoter regards, in its sole discretion, to be offensive or obscene in any way or to not be in compliance with these Terms. By entering this Promotion the entrant agrees to indemnify the Promotor and The Face against any third party claims for copyright infringement.

9. General

9.1 The promoter accepts no responsibility for entries that are lost, delayed or damaged for any reason whatsoever. Incomplete entries or those not in accordance with the entry instructions will not be accepted.

9.2 The winner of the cash prize shall be responsible for seeking advice as to the payment of any income tax, national insurance contributions or other such tax for which the winner may be liable as well as for report cash prize to the relevant tax authorities. The winner indemnifies and holds harmless the Promoter and The Face from any and all claims in respect of taxes and national insurance payments owed by them.

9.3 Entrants agree that, to the extent permissible by law, the Promoter and The Face and its affiliates, agents assume no liability for injuries, losses or damages or any kind to property or persons, including without limitation death, resulting in whole or part, directly or indirectly, from the management of or mechanics behind the Promotion, entry into the Promotion, the acceptance of the Prizes, and any acts or omissions of the winners. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence.

9.4 In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/​or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

9.5 The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook or Twitter. The entrant acknowledges that Instagram does not accept any liability whatsoever for any damages which may be incurred as a result of entry into this

Promotion. Entrants must adhere to the terms and conditions of use of Instagram, Facebook and Twitter.

9.6 These Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
